1. Acceptance of These Terms

These Terms of Service govern your use of the website operated by DPBC CONSTRUCTION LLC and any services you request through it. DPBC CONSTRUCTION LLC is a concrete and structural construction contractor located at 663 N 100 E, Springville - 84663-5698, United States (US). By accessing this website or requesting a service, you agree to be bound by these terms. If you do not agree, please do not use the website.

The developer known as Delta Build built and supports this website for the company. These terms apply to the website and to any quote, enquiry or communication that begins here.

Please read these terms carefully before you use the website or request work. They explain what you can expect from the Company and what the Company expects from you. They also describe the limits of the information published on this website and the way that a binding agreement is actually formed. If you have a question about any part of this document, contact the yard before you proceed.

2. Definitions

In these terms, the words the Company, we, us and our refer to DPBC CONSTRUCTION LLC. The word website refers to this site and its pages. The word services refers to concrete and structural construction work that the Company offers, including foundation forming and pours, structural wall panels, flatwork and driveways, curb and sidewalk machine runs, grade and layout staking, and concrete repair and patching. The word you refers to any visitor, client, builder, supplier or other user of the website or the services.

The word agreement refers to a signed contract, an accepted written proposal or a confirmed purchase order. The word work refers to the concrete and structural construction activity that the Company performs under an agreement. Singular words include the plural and the reverse. A reference to a statute includes any amendment or replacement of that statute.

3. Eligibility to Use the Website

This website is intended for adults and for businesses. By using it you confirm that you are at least eighteen years of age and that you have the authority to act on behalf of any organization you represent. If you use the website on behalf of a company, you confirm that you may bind that company to these terms.

If you do not meet these conditions, you may not use the website. The Company may decline to provide services at its discretion where it has a lawful reason to do so, including where a project falls outside the capabilities of the Company or where the site cannot be worked safely.

4. Scope of Services

The Company forms, pours and finishes concrete for foundations, structural walls and flatwork. The services listed on this website describe our general capabilities. A binding scope of work is created only through a signed agreement, an accepted written proposal or a purchase order that the Company has confirmed in writing. Website descriptions, illustrations and examples are informational and do not by themselves create a contract.

The Company forms, pours and finishes concrete for foundations, structural wall panels, flatwork and driveways, curb and sidewalk machine runs, grade and layout staking, and concrete repair and patching. Each of those services is delivered from the formwork yard in Springville, and each is subject to the specific scope agreed for the project. Photographs, plans and drawings shown on the website are illustrative of the type of work the Company performs and are not a promise that a particular result or dimension will be delivered.

5. Quotes, Estimates and Pricing

Any quote or estimate provided through this website or by email is valid for the period stated in the document. If no period is stated, the quote is valid for fourteen days from the date it is issued. Prices may change where the scope of work, the site conditions, the material cost or the schedule change. All prices are exclusive of taxes unless the document states otherwise. The Company may correct clerical errors in a quote before work begins.

An estimate is a good faith calculation based on the information available. It is not a fixed price unless the document says it is fixed. Where a project is priced by measurement, the final amount follows the measured quantities. Where a project is priced as a lump sum, the amount holds while the scope holds, and a change to the scope adjusts the amount through a change order.

6. Scheduling and Access

Pour dates and crew scheduling are set from the Company formwork yard in Springville. A confirmed date depends on site readiness, weather, material availability and inspection approval. You agree to provide safe and timely access to the project site, to keep the work area clear and to obtain any permits or approvals that the project requires. Where a delay is caused by site conditions outside the control of the Company, the Company may reschedule the work and adjust the price for standing time.

Pour days are confirmed with the pump operator and the ready mix supplier the day before. You agree to have the site ready, the forms inspected and the reinforcement in place before the crew arrives. Where the site is not ready, the Company may stand down the crew, and standing time may be charged at the agreed rate.

7. Site Conditions and Subsurface Work

Concrete work depends on conditions below and around the surface. The Company bases its forming, grading and pour plans on the information available at the time of the quote. If the Company encounters unforeseen soil conditions, groundwater, buried utilities, rock or unstable ground, the parties will agree in writing on the additional work and cost required. The Company is not responsible for defects that arise from inaccurate site information supplied by others.

Excavation reveals what a geotechnical report can only estimate. Where the ground is softer, wetter or harder than the report predicted, the forming, dewatering or backfill plan may need to change. The Company will report such conditions promptly so that the parties can agree on the correct response rather than discovering a problem after the pour.

8. Client Responsibilities

You agree to provide accurate project information, to disclose known site hazards, to secure utilities before excavation and to ensure that the design and engineering for the structure are complete and correct. You agree to obtain the inspections required by the local authority and to keep the site safe for crews. Where you supply materials, you confirm that they meet the relevant standards and that they are delivered to the site on time.

You also agree to tell the Company about any hazardous material on the site, any easement or restriction that affects the work and any condition that could endanger a crew. The Company is entitled to stop work where a condition makes the site unsafe, and the schedule will be adjusted for the delay that follows.

9. Changes and Change Orders

Any change to the agreed scope, schedule or materials must be documented in a written change order that both parties accept. A change order will describe the added or reduced work and the effect on price and time. The Company will not be required to perform changed work until the change order is accepted. Verbal instructions that change the scope will not be binding.

A change order protects both parties. It records what was added or removed, when the change takes effect and how the price and schedule move. Where work must proceed before a change order can be signed, the Company may do so on a written direction that the parties agree will be converted to a change order, and the written direction will be treated as part of the agreement.

10. Payment Terms

Unless a written agreement states otherwise, invoices are due within thirty days of the invoice date. The Company may require a deposit before mobilizing to the site. Progress payments may be required for work that spans multiple placements. Late amounts may accrue interest at the rate permitted by law. The Company may suspend work where an invoice remains unpaid and where the suspension is lawful under the agreement.

Payments may be made by the methods the Company lists on its invoice. A payment is treated as received when it clears. Where a payment is disputed, the undisputed portion remains payable on time, and the parties will resolve the disputed portion promptly and in good faith.

11. Warranty and Workmanship

The Company warrants that its work will be performed in a workmanlike manner and in accordance with the agreed scope and applicable building codes. Unless a written agreement states a longer period, this warranty runs for one year from substantial completion. The warranty does not cover damage caused by movement of the structure, misuse, neglect, chemical attack, freezing of fresh concrete, work performed by others or normal wear. Concrete is a variable material, and minor variations in color and surface texture are normal.

The warranty applies to the work of the Company and does not extend to materials or work supplied by others. To make a warranty claim, notify the Company in writing within the warranty period and allow a reasonable opportunity to inspect the work. Where a covered defect is confirmed, the Company will repair or replace the affected work as its remedy. This warranty is in addition to any rights that the law gives you and does not replace them.

12. Limitation of Liability

To the fullest extent permitted by law, the Company will not be liable for indirect, incidental, special or consequential damages, including lost profits, lost revenue or delay damages. The total liability of the Company for any claim arising out of the services or the website is limited to the amount paid to the Company for the specific work that gave rise to the claim. Nothing in these terms limits liability that cannot be limited by law.

Concrete work is subject to natural forces, including settlement, thermal movement and the behavior of the soil under the structure. Those forces can affect a completed surface over time, and the Company is not responsible for changes that result from them where the work was performed to the agreed scope and the applicable code.

13. Intellectual Property

The content of this website, including text, layout, graphics and source code, is owned by the Company or used with permission. You may view and print pages for your own reference. You may not copy, reproduce, republish or distribute the content for commercial purposes without written permission. The names, logos and marks of the Company remain the property of the Company.

You may quote a short passage of the website with a clear reference to the Company. You may link to any public page of the website. You may not frame the website inside another site or present the content of the website as your own. Where you believe that your own rights have been used on this website without permission, contact the Company and the matter will be reviewed promptly.

14. Acceptable Use of the Website

You agree not to misuse the website. You will not attempt to gain unauthorized access to any system, interfere with the operation of the site, submit false or misleading information, or use the site to transmit unlawful material. Where the Company believes that misuse has occurred, it may restrict access and take any other lawful steps it considers appropriate.

The website is provided on an as available basis. The Company does not promise that the website will be free of interruption or error, though it works to keep the site running and the content accurate. Where the website is unavailable for a period, the Company remains reachable by phone at +14849108640 and by email at general@deltabuild.lol.

15. Third Party Content and Links

The website may link to sites and resources that the Company does not control. Those links are provided for convenience only. The Company does not endorse and is not responsible for the content, products or practices of any third party site. You access third party sites at your own risk and subject to their own terms.

The Company is not responsible for decisions that you make on the basis of information found on a third party site, even where the Company linked to it. If a link on this website is no longer correct, tell the Company and it will be reviewed.

16. Indemnification

You agree to indemnify and hold harmless the Company and its members, officers, employees and subcontractors from claims, damages, losses and expenses that arise from your breach of these terms, your misuse of the website or your failure to meet your responsibilities under an agreement. This obligation survives the end of your use of the website.

17. Force Majeure

The Company is not liable for delay or failure to perform where the cause is beyond its reasonable control. Such causes include severe weather, flooding, fire, labor disruption, material shortages, utility failure, government action and other events that make performance impractical. The affected schedule will be adjusted by the length of the delay.

18. Termination and Suspension

The Company may suspend or terminate access to the website at any time and without notice where it is necessary to protect the site or to comply with the law. Either party may terminate a services agreement in accordance with its terms. On termination, the client remains responsible for payment for work performed and materials supplied up to the date of termination.

19. Dispute Resolution

The parties agree to attempt to resolve any dispute through good faith discussion before starting formal proceedings. If discussion does not resolve the matter, the parties may agree to mediation. Any legal action will be brought in the courts that have jurisdiction over the place of business of the Company. Each party bears its own costs unless the law provides otherwise.

20. Governing Law

These terms are governed by the laws that apply at the place of business of the Company in the United States. If any provision of these terms is found to be unenforceable, that provision will be limited or removed to the smallest extent necessary, and the remaining provisions will stay in full force.

21. Changes to These Terms

The Company may update these terms from time to time. The current version is always the version published on this page, and the date at the top indicates when it was last changed. Continued use of the website after an update means that you accept the revised terms. We encourage you to review this page periodically.
